It’s one of my favorite questions because that’s one of the first things that everybody always says when they call is that they never read any Miranda. It’s one of the things that TV has really mislead people into believing.

Law enforcement does not have to read you your Miranda Rights unless you’re under arrest and they ask you questions. If they ask your questions before you’re under arrest, they don’t have to read them. It’s only have they say “you’re under arrest,” or they place you in handcuffs and then they start questioning you. If they arrest you and take you to jail, they don’t have to read you Miranda. It’s simply to tell you what your rights are as a person under arrest being questioned by law enforcement.

Most of the time, law enforcement doesn’t use Miranda kinds of things except for extremely serious cases.
